INTERESTING MELANGE.

A Chronological Record of Events as they have Transpired in the City and County since our last Issue.

Miss Bessie Wright has returned from Texas, where she has been teaching voice culture. She will go in about a month to Southern Texas to pursue a special course in study under a teacher from New York, who will spend the summer there.

Miss Lizzie Hammons, a well known former Carthage teacher who has recently been teaching in the public schools at Ft. smith, Arkansas, returned to her home in this city Saturday night.

Major H. H. Harding delivered the decoration day address at Webb City this morning. The exercises were held in the Methodist church and a large crowd was present.

D. H. Paulding returned Saturday afternoon from Chicago where he had been the past five weeks.

In a odd coincidence, City officials received some calls of concern over the height of the grass at Kellogg Lake on the eve of the signing of the settlement with Coffee over the Management Agreement.

This is ironic because the original intention of the Park Board entering into the agreement was to help reduce the amount of land maintained by the Parks and Recreation Department.

The grass was being attended to on Monday. The Park staff was directing its efforts toward the sprucing up of Muni Park for the Fourth of July fireworks display during the preceding week and Kellogg Lake maintenance was delayed.

Since I don’t know ‘xactly how many calls actually came in about Kellogg Lake, it’s hard to make any real assessment of the interest. I will use this opportunity to again point out the value of the various parks and the importance that is placed on this community asset. Too often such value becomes apparent only when the well runs dry.

This is some fact, but mostly, Just Jake Talkin’.

Five Year Dispute with Coffee Ended.

The City Council voted unanimously last Tuesday to end what City Attorney David Dally called the “five year negotiation” with Clifford Coffee.

The Council agreed to pay Coffee $44,352 as a settlement for disputes filed by Coffee regarding the Kellogg Lake Management Agreement entered into with the Park Board in early 1992.

Several closed session meetings were called to discuss the dispute over the last years. There was no discussion during the regular Council meeting, only a quick vote.

The Management Agreement leased the Kellogg Lake area to Coffee and removed responsibility from the Park Board for maintenance and management. The City Council stepped in and disallowed the agreement after citizens complained of limited access to the area and signs were posted indicating the park was under private management.

The agreement to settle is reproduced in full on the inside of today’s issue of the Mornin’ Mail.

WHEREAS the parties desire that this Agreement constitute a full and complete settlement and discharge of all claims with respect to the Management Agreement;

NOW, THEREFORE, in consideration of the foregoing, the forbearance of litigation, and other good and valuable consideration, the receipt and sufficiency of which the parties acknowledge, Coffee and the City agree as follows:

1. Status of Management Agreement. The Management Agreement shall hereby be deemed void.

2. Payment to Coffee. Upon the execution of this Agreement, the city shall pay Coffee the sum of $44,352. Such sum shall be considered compensation to Coffee for the loss of the economic advantages that Coffee would have received had the development and management of Kellogg Lake Park been completed as contemplated by the Management Agreement.

3. Acceptance By Coffee. Coffee accepts the payment set forth in Paragraph 2 as a full and complete settlement and discharge of all claims that he has, or may have, arising out of, or in any way related to, the transaction that is the subject of the Management Agreement.

4. Release By City and Board. The City and the Board each hereby releases and forever discharges Coffee, his heirs, personal representatives, and successors in interest, from any and all actions, causes of action, suits, sums of money, controversies, damages, judgments, executions, claims, and demands whatsoever, in law or in equity, that they or either of them had, has, or in the future may have, whether known or unknown, arising out of, or in any way related to, the Management Agreement.

5. Release By Coffee. Coffee hereby releases and forever discharges the City and the Board from any and all, actions, causes of action, suits, sums of money, controversies, damages, judgments, executions, claims, and demands whatsoever, in law or in equity, that Coffee had, has, or in the future may have, whether known or unknown, against either of them, arising out of, or in any way related to, the Management Agreement.

6. Nonadmission By Parties. The parties recognize and agree that this Agreement constitutes a settlement of disputed claims and defenses solely for the purpose of avoiding prolonged and costly litigation. By entering into this Agreement, none of the parties shall be deemed to have agreed to, or acquiesced in, the validity or invalidity of the claims or defenses of any of the other parties.

7. Authority to Execute Agreement. The City and the Board represent and warrant that the persons executing this Agreement for them have been granted the authority to do so by proper action of the City Council and the Board, respectively.

What a gorgeous 4th of July! Can you believe that we had to put on jackets to watch the fireworks? Thanks to the City and Precious Moments, we were able to get our fill of fireworks shows right here in Carthage.

Bilberry, the latest herb to impress me. When I was teaching some classes in Springfield a couple of years ago, I noticed that my night vision was not what it used to be, so I started taking a Bilberry formula. It was not long before I noticed that the headlights were no longer running together, and that I could actually see individual headlights and my peripheral vision was improved. As we so often do, when I finished my night drives, I quit taking Bilberry. Well, this past month I noticed I was having trouble seeing to back up in the dark and it was harder to traverse when on a summers' night walk. Out with the Bilberry again! It has been just a few weeks and I am beginning to notice a slight difference, but having had experience with it, I know that it will continue to improve. As you know, some people get faster results than others. Many of our customers are pleased with it and continue to take it on a regular basis.

It is time for me to harvest my peppermint. I am eager to make some syrup and dry the rest for later use. Peppermint has traditionally been used to calm the digestive system and also as a mild nervine. It is quite good in iced tea. Add a small amount to your tabouli and taste the difference. I have plenty and would be happy to share with some of you should you want some.
